Terms of Service

Effective October 28, 2026

These Terms of Service (“Terms”) govern your access to and use of FarmSend, including its maps, ownership analyses, downloadable files, and related services (the “Service”). By using the Service, you agree to these Terms.

1. Eligibility and accounts

You must be at least 18 years old and legally able to enter a contract. You are responsible for accurate account information, safeguarding your credentials, and all activity under your account. Notify us promptly if you believe your account has been compromised.

2. Data source

FarmSend compiles landowner and parcel information from county public records obtained through a licensed parcel data provider. We do not create the underlying assessor or recorder records. FarmSend is not a title company, and a purchased list is not a title report, survey, appraisal, or legal opinion.

3. Service and permitted use

FarmSend provides informational tools for researching land ownership and creating filtered prospect lists. You may use a purchased export only for your own lawful internal business purposes. You may not resell, sublicense, republish, or redistribute the list or any substantial extract of it.

If you contact anyone from a purchased list, you must follow CAN-SPAM, the Telephone Consumer Protection Act (TCPA), and other applicable anti-spam, telemarketing, privacy, fair-housing, and consumer-protection rules. FarmSend does not grant permission to email, text, or call anyone.

You may not scrape, reverse engineer, resell access to the Service, bypass purchase controls, or interfere with the Service.

4. Per-address pricing

FarmSend does not require a subscription. The price of an export is based on the number of addresses in the list you purchase. The amount due is calculated on our servers and shown before you pay.

5. Purchases, refunds, and card handling

Payments are processed by Stripe. FarmSend does not store full card numbers. Cards are not saved for later one-click reuse unless that feature is later enabled. FarmSend emails a receipt for each completed purchase to your account email.

Because the product is a digital download, completed purchases are generally not refunded except where required by law or where FarmSend fails to deliver the purchased file. If Stripe records a refund or an open payment dispute, download access to that purchase is revoked. A refund or chargeback does not authorize continued use of a previously downloaded file where the law does not permit it.

While a purchase remains paid and not refunded or disputed, the file remains available in the purchasing account for repeat download.

6. Intellectual property

FarmSend and its software, branding, designs, and compilation of information are protected by intellectual-property laws. These Terms grant only a limited, non-exclusive, non-transferable right to use the Service. No ownership rights are transferred to you.

7. Third-party services

The Service relies on third-party hosting, payment, mapping, and infrastructure providers. Their terms and privacy practices may apply to your interactions with their services. FarmSend is not responsible for third-party outages or acts.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, FARMSEND DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FARMSEND WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION. FARMSEND’S TOTAL LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID FARMSEND DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold FarmSend and its operators harmless from claims, losses, and expenses arising from your misuse of the Service, your exported-list activities, or your violation of these Terms or applicable law.

11. Suspension and termination

We may suspend or terminate access when reasonably necessary to protect the Service, comply with law, prevent fraud or abuse, or address a material violation of these Terms. Provisions that by their nature should survive termination will survive.

12. Governing law

These Terms are governed by the laws of the State of Iowa, without regard to conflict-of-law principles. Any dispute not resolved informally will be brought in the state or federal courts located in Iowa, and each party consents to their jurisdiction.

13. Changes and contact

We may update these Terms by posting a revised version with a new effective date. Continued use after an update constitutes acceptance. Questions may be sent to support@farmsend.us.
